Age restrictions

• Platforms would be prohibited from allowing access to children under 13 on covered social-media services.
• 15 years is proposed as the EU-wide minimum age for a minor to independently create an account on covered social-media platforms.
• The framework allows a gradual approach involving parental responsibility for younger users.

Safety by Design

• Platforms must consider children''s safety during the design of digital services, rather than addressing harms only after they occur.
• The proposal effectively shifts the burden of proof toward service providers: platforms must demonstrate that their services are age-appropriate and safe.

Age Assurance

• Promotes an EU-wide approach to determining whether a user meets relevant age requirements.
• The EU is developing privacy-preserving age-verification mechanisms so that age checks do not unnecessarily expose users'' identities.

Determining Electoral Identity Beyond the Symbol

The Election Symbols (Reservation and Allotment) Order, 1968 becomes particularly important when rival factions of a recognised political party claim the party''s name, reserved symbol and electoral identity.

What is the Election Symbols Order, 1968?

The Order provides the framework for:

• Recognition of political parties
• Reservation of election symbols
• Allotment of symbols to candidates
• Resolution of disputes between rival factions of recognised parties

Constitutional & Legal Framework

•  Article 324: Vests the Election Commission of India (ECI) with superintendence, direction and control of elections.
• Section 29A, RPA 1951: Provides for registration of political parties with the ECI.
• Election Symbols Order, 1968: Provides the operational framework for recognition and symbol allocation.
• Paragraph 15: Enables the ECI to determine disputes where rival groups claim to be the recognised political party.

What Happens During a Party Split?

The dispute may involve three interconnected claims:

• Party Name: Which faction can use the recognised party''s name?
• Reserved Symbol: Which faction is entitled to the party''s reserved electoral symbol?
• Organisational Identity: Which faction should be treated as representing the recognised party?

Thus, the issue goes beyond ownership of a symbol.

Significance of an Election Symbol

Sadiq Ali v. Election Commission of India (1972)

Background

• The Indian National Congress split in 1969 into two rival groups — Congress (O) and Congress (J).
• Both groups claimed to be the genuine Indian National Congress and sought the party''s reserved election symbol, “Two Bullocks with Yoke on.”
• The dispute came before the Election Commission under Paragraph 15 of the Election Symbols (Reservation and Allotment) Order, 1968.

Key Issue

Could the ECI decide which rival faction of a split political party was entitled to the party''s reserved election symbol?

Supreme Court Held, Yes.

The Court upheld the validity of Paragraph 15 and recognised the ECI''s jurisdiction to resolve disputes between rival groups claiming the same recognised political party and its reserved symbol.

Important Principles

• ECI has jurisdiction : The ECI can inquire into rival claims when a recognised political party splits and competing factions claim its reserved symbol.
• Majority support is relevant : The ECI could consider the numerical strength/support of the rival groups, including their strength among legislators, as a relevant criterion.
• Symbol is not property : The Court treated the election symbol as part of the electoral framework, not as ordinary property belonging to a political party or faction.

• Polymetallic nodules are potato-sized mineral deposits found on the deep-ocean floor and contain economically important metals such as manganese, nickel, cobalt and copper.

Why is India Interested?

• Critical Mineral Security: India has a growing requirement for minerals essential for batteries, electronics, renewable energy and advanced industries.
• Supply-Chain Diversification: Seabed resources could provide an additional source beyond geographically concentrated terrestrial supplies.
• Energy Transition: Critical minerals are important inputs for EVs, batteries and clean-energy technologies.
