The Constitutional Limits of Bar Association Boycotts

The Ayodhya (Faizabad) Bar Association recently resolved that its members would not represent persons accused in the alleged Ram Temple donation fund embezzlement case and announced a monetary penalty for any lawyer who accepted the brief. The incident has revived concerns over the constitutional right of an accused to legal representation and the legality of such bar association resolutions.

Constitutional basis of the rights to legal Representation 

The Constitution guarantees every accused person the right to a fair legal defence, irrespective of the nature of the alleged offence.

»     Article 22(1): Guarantees every arrested person the right to consult and be defended by a legal practitioner of their choice.

»     Article 14: Ensures equality before the law and equal protection of laws.

»     Article 21: The Supreme Court has interpreted the right to life and personal liberty to include the right to a fair trial.

»     Article 39A: Directs the State to provide free legal aid so that justice is not denied due to economic or other disabilities.

The Bar Council of India (BCI):

The Bar Council of India (BCI) Rules on Professional Conduct require advocates to accept briefs in courts or tribunals at a reasonable fee, subject only to limited personal exceptions.

»     An individual advocate may decline a case due to special circumstances.

»     However, a Bar Association cannot collectively prohibit its members from representing a particular accused.

»     In Kuldeep Agarwal v. State of Uttarakhand (2019), the Uttarakhand High Court clarified that "special circumstances" apply only to an individual lawyer''s decision and cannot justify collective boycotts.

Caste Enumeration Takes Shape Ahead of Census 2027
